Llama Kart Terms of Use
The terms under which the game is provided.
Agreement
These terms apply to Llama Kart, a game published by Code Lama Software. By downloading or playing it you accept them. Llama Kart is distributed through Apple's App Store, and Apple's own Licensed Application End User License Agreement applies in addition to these terms; where the two conflict on a matter Apple's agreement governs, Apple's agreement wins.
Licence
You are granted a personal, non-exclusive, non-transferable licence to use Llama Kart on Apple devices you own or control, as permitted by the App Store terms. You may not redistribute it, sell it, rent it, reverse-engineer it except to the extent that applicable law expressly permits, or remove any notice from it.
Your game data
Your progress is yours. It is stored on your device and, through Game Center, in your own iCloud account. Code Lama Software does not hold a copy and therefore cannot restore one: if you delete the app or your saved game and have no backup, the progress is gone. Keeping a device backup is the only recovery there is, and it is yours to keep.
No purchases
Llama Kart contains no in-app purchases, no subscriptions and no purchasable currency. Nothing in the game can be bought, so there is nothing to refund. Any charge for the app itself is handled by Apple under Apple's terms, and refund requests go to Apple.
Availability
Llama Kart runs entirely on your device and does not require a network connection to play. Game Center features — leaderboards, achievements and saved-game sync — depend on Apple's services and on your being signed in; when they are unavailable the game continues to work and simply submits nothing.
Disclaimer
Llama Kart is provided "as is" and "as available", without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Code Lama Software does not warrant that the game will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, Code Lama Software is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data or progress, arising out of your use of Llama Kart. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, and if you are a consumer you keep every statutory right your jurisdiction gives you.
Changes
These terms may change as the game does; the date at the top changes with them. Continuing to play after a change means accepting the revised terms.
Governing law
These terms are governed by the laws applicable at Code Lama Software's principal place of business, without regard to conflict-of-laws rules, and without depriving a consumer of the protection of mandatory provisions in their country of residence.
